Bullying, Harassment, & Discrimination Prevention

The Marin County Office of Education is committed to providing a safe environment free from discrimination, harassment, intimidation, and bullying for all students, regardless of actual or perceived race, color, ancestry, national origin, nationality, ethnicity, ethnic group identification, age, religion, marital or parental status, physical or mental disability, sex, sexual orientation, gender, gender identity, gender expression, or association with a person or group with one or more of these actual or perceived characteristics. (Ed Code 234.1)

Definitions

Discrimination

Harassment, Including Sex-Based Harassment

Harassment is unwelcome conduct, whether verbal, physical, or visual, based on one or more protected characteristics, that is severe, pervasive, or objectively offensive enough to interfere with a student's ability to participate in or benefit from MCOE's educational programs or activities.

Sex-based harassment includes unwelcome conduct of a sexual nature, sex-based stereotyping, sexual assault, dating violence, and related conduct that interferes with a student's access to education. (See BP 5145.71)

Bullying and Cyberbullying

Bullying is a severe or pervasive physical or verbal act or conduct, including communications made in writing or by means of an electronic act, directed toward one or more pupils, that has or can reasonably be predicted to place the pupil(s) in reasonable fear of harm, cause substantial detrimental effect on physical or mental health, or substantially interfere with academic performance or participation. (Ed Code 48900(r))

Cyberbullying is bullying conducted through electronic acts: transmitting a communication, image, or video via an electronic device including a telephone, computer, or any similar system, by means of a social network internet website, instant messaging, comment forum, or image/video posting platform.

How to Report

If you or your child has experienced or witnessed discrimination, harassment, intimidation, or bullying/cyberbullying:

Report it to a school administrator, counselor, or teacher.
Submit a formal complaint via the Uniform Complain Procedures

Social Media Bullying

Bullying may occur on social media platforms, including:

Internet websites with free registration and free content
Peer-to-peer instant messaging platforms
Online comment forums
Image or video posting platforms

Examples include, but are not limited to: Instagram, Snapchat, TikTok, Discord, YouTube, and group messaging applications. MCOE treats bullying conducted through any of these channels the same as bullying that occurs on school grounds when it substantially disrupts the educational environment.

Marin County Office of Education is committed to supporting neurodivergent learners and the families and educators who serve them.
